PUBLIC HEARING

Area Variance Request

Nicole Taylor and Charles Smith – 21 Whitewood Tract, Phoenix

Tax Map #303.01-01-16

 

Chairman French opened the Hearing at 7:03 pm.  The applicants explained that they had purchased additional property behind their current residence in July and merged the two parcels through the County Clerk in September in order to purchase a new home and locate it further back on the property.  A site plan was provided by the applicants, a surveyed map of the property, which located the current residence, two greenhouse structures, the driveway and well.  They also located the proposed new home location which overlaps the merged property lines.  The applicants are requesting a variance to allow them to reside in their current home while the new residence is constructed.  The Board members had no questions, the Hearing was opened to public comment, and there were no comments.  Chairman French closed the Hearing at 7:07 pm.

REGULAR MEETING

 

The Regular meeting was opened at 7:07 pm.

Without any further discussion from the Board Members a motion was moved by   Member LeoGrande and seconded by Member Farrands, to allow the applicant to reside in the existing structure during the installation of

the new proposed home on property located at 21 Whitewood Tract, Phoenix, NY 13135 ; Tax Map # 303.01-01-16 is hereby GRANTED with the following express conditions:

1.)    Must be in accordance with CEO requirements regarding the issuance of a Demolition Permit previous to the issuance of a Certificate of Occupancy for the new home.

2.)    Allowance of a six month time frame in which to demolish existing home.

3 AYES 0 NAYES  - Resolution 2017-14 - APPROVED

 

MINUTES

A motion was moved by Member Farrands to approve the meeting minutes for October 4, 2017.  The motion was seconded by MemberLeoGrande, all were in favor without further discussion and the motion carried.

 

ADJOURN

With no other business before the Board a motion to adjourn at 7:09 pm was moved by Member Farrands and seconded by Member LeoGrande, all were in favor and the motion carried.
