Variance Request
James Schultz – 768 State Route

Tax Map #270.04-02-02
Chairman
French stated that the Public Hearing opened at the November 9th
meeting had been tabled and was still open, discussion resumed at 7:01pm. Chairman French had spoken to the CEO, Dave
Hanford, regarding the existing retaining wall and was told that it wouldn’t
have needed a building permit to be placed and therefore it wouldn’t have
required an inspection either. The CEO
did state that foundations do require inspection and therefore the existing
retaining wall would not be able to be used for the structure in question. A new design plan inclusive of foundation
specifications would need to be submitted to the CEO for his review and
approval before the ZBA could take action on the pending application. A motion
was moved by Member Farrands to
table the Hearing and allow the applicant time to formulate a new design. The motion was seconded by Member LeoGrande,
all were in favor and the motion carried. Chairman French reiterated to the applicant
that if he presented a proper plan for building the structure then the ZBA
could look at the setback request.
