The
regular meeting was opened and called to order at 7:00 pm by Chairman French. He began the meeting with an apology to the
applicants for being unable to attend the December 16th meeting, as did Member
Thompson.

PUBLIC HEARING

Chairman French opened the Hearing at 7:01 pm and asked the
applicant to explain the reason for the Area Variance request. The applicants explained that they had
purchased the property at auction and had recently removed the existing mobile
home as well as several truckloads of accumulated garbage from the site. They were now beginning to renovate the
garage into living space which would be connected to a large 24’ x 30’ addition
by a hallway and wrap around porch.
William Widger further explained that he had been replacing the windows
in the garage when he received a notice from the Codes office to stop work and
apply for a building permit and ZBA request if utilizing the existing structure
which is 3’6” from the property line on the north side. The dimensional requirement for side yard
setback for an existing undersized residential lot is 8’, they are therefore
requesting a 4’6” variance. The Board
Members reviewed the submitted site plan and commented that the addition and the
connecting hallway are farther from the property line than the minimum 8’, and
that the floor plan design suggests limited activity along the north property
line which provides privacy for both properties. Member Thompson asked for the front setback
measurement, Carol Widger supplied a survey map (for the file) that detailed
the dimension at 36’ – edge of road to corner of structure. The Town’s requirement is a 25’ front setback
which leaves 9’ for the proposed porch, to which the applicants answered they
planned on 6’ wide porch. Without
further discussion, the Public Hearing was closed at 7:15 pm by Chairman
French.

The Regular meeting which was previously opened resumed
session at 7:16 pm.
WILLIAM AND CAROL
WIDGER - Without any further discussion from the Board Members a motion
was moved by Member Patricia
Simmons and seconded by Member Tom Thompson to accept the requested Area Variance for side
yard setback dimension of 3’6” for existing building placement for the purposes
of renovating and building residential addition on property located at 399 Pendergast Road, Phoenix, tax map# 288.04-02-11
is hereby GRANTED with the following express conditions: NONE.

MINUTES
A motion to
approve the meeting minutes with minor corrections for November 25, 2014 was moved by Member Patricia Simmons and
seconded by Member Tom Thompson, all were in favor, motion carried.
With no other business before the Board a motion to
adjourn at 7:25 pm was moved by Member
Peter LeoGrande and seconded by Member Patricia Simmons, all were in favor, motion carried.
