ZONING BOARD OF APPEALS
TOWN OF GRANBY
IN THE MATTER OF THE APPLICATION OF
Dan and Kristine Frauenhofer
FOR AN AREA VARIANCE RESOLUTION 2009-01
WHEREAS, the Applicants, Dan and Kristine Frauenhofer have appealed to the Zoning Board of Appeals for an AREA VARIANCE from Section IV, Subsection B of the Town of Granby Zoning Ordinance for relief from side set-back restriction to extend the west end of an existing non-conforming structure that is 4.11' from the north property line on property located at 2082 County Route 8, Fulton, tax map # 201.00-02-1.2. and,
WHEREAS, a notice of public hearing was duly published in the official newspaper of the Town of Granby at least (5) days prior to the date of such public hearing, and all additional notices thereof having been made as required by law, and
WHEREAS, a public hearing was held on Tuesday October 20, 2009 upon the above referenced matter, and,
WHEREAS, at said hearing all those interested in said variance were heard either in favor or in opposition there to, and,
The Board has relied on verbal representations made by the applicants during the course of this proceeding as noted in the applicable Board Minutes. The validity of these statements are expressly made a condition of this approval.
NOW THEREFORE, upon motion duly made by Chairman Holmes and seconded by Member Leogrande,
BE IT RESOLVED, by the Zoning Board of Appeals for the Town of Granby, upon the facts presented and the determination made, that the area variance application for a 4.11' side setback variance on property located at 2082 County Route 8, Fulton, tax map # 201.00-02-1.2 is hereby GRANTED with the following express conditions: None.
