Granby Town Board Regular Monthly Meeting

    June 10, 2009                          DRAFT

7:00 P.M.

Supervisor Williamson called the meeting to order leading those present in the salute to the flag.

Present for the roll call:  Supervisor Ed Williamson and Councilors:  Sue Richardson; Carol Abbott; Matt Callen.  Councilor Ellen Nowyj was excused.  Also present:  Highway Superintendent Lynn Moyer; Deputy Supervisor Joe Cortini; Budget Director Bob Lyman; 8 residents and guests.

A motion was made by Councilor Richardson, seconded by Councilor Abbott to dispense with the reading of the minutes of May l3 & 27, 2009 and accept them as written.  Passed unanimously.

Public Comment

Rodney DeLong notified the Board that trucks are taking water from the fire hydrants.  He has talked to OCWA about it and learned that it is legal (the truckers have meters they are supposed to attach and pay OCWA for the water).  However, Mr. DeLong feels it is unfair for OCWA to sell water from equipment our residents have paid for and not give a break or kickback to Town residents for such sales.  He also noted that the water pressure in his house goes way down when the truckers are filling up.  Supervisor Williamson suggested he would have Attorney Chatfield write a letter to OCWA regarding this.  He also noted that the cost of water would be going up 10% per year until 2012.

Mr. DeLong reminded the Board that he had to pay $400 extra to have a "hump" removed when he had his driveway paved.  The "hump" was somehow related to the installation of Water District #3 water pipes.  Supervisor Williamson recommended that DeLong read the minutes from the May 27th meeting.  DeLong stated that he would give the Town 30 days to reimburse him.

Communications and Announcements

Miller Engineering is working on securing funding through the USDA for an addition & extension to Water District #3.  Should funding be approved, the extension would include portions of Wybron  Rd; County Routes 14 & 55; County Line Rd; Ritchie Rd; Merritt Rd; Prall Rd; and side streets off of some of these roads.  There would need to be a Public Hearing and the residents in the area would have to vote to approve the extension.  Signatures have been obtained for the extension in 2007, 2008 & 2009.

The new Dunkin' Donuts has opened in the Mall parking lot on State Rt. 3.

Saturday, July 18, 2009 has been set for Granby Family Fun Day at the Granby Community Center.  It will run from 12:00-3:00 p.m.  Many free activities are planned and food will be available for purchase.  Nominations for "Citizen of the Year" need to be submitted by June 24th.

Old Business

Jim Karasek has been hired to do the 2009 Granby Dog Census. 

The Duncan's attorney has served the Town of Granby with a "Notice of Claim" concerning costs they may incur due to being denied a Zoning Variance for the third time.  The "Notice of Claim" has been turned over to NYMIR, the Town insurance company and will be handled by them.

New Business

Highway Superintendent Moyer and Supervisor Williamson will proceed to gather all pertinent information regarding the possible sale of Town property on Stoney Robby Rd.  After all the information has been received and discussed by the Town Board a Public Hearing will be scheduled.

There are two bridges in the Town that are in need of repair.  The bridge in poorer condition is on Honey Hill Rd. The other bridge is on Lakeshore Rd.  Highway Superintendent Moyer has had the County Highway Superintendent look at both bridges.  A written quotation on the cost of repair will be submitted.

Motions and Resolutions

The Town Clerk read the entire SEQR Short Environmental Assessment Form regarding the 13.39 acres of undeveloped land on State Route 3 west of Rathburn Rd. requested to be rezoned from "CT" to Agricultural. 

Resolution #20-2009 was made by Councilor Richardson, seconded by Supervisor Williamson: 

WHEREAS the Town of Granby Town Board has reviewed the Short Environmental Assessment Form as required by the NY State Environmental Quality Review Act regarding a zoning change from "CT" to Agricultural for real property tax ID #234.00-01-5.07,

NOW THEREFORE BE IT RESOLVED that the Town Board of the Town of Granby finds no significant adverse environmental impact associated with said request to change the zoning and does hereby issue a negative declaration.

Resolution #21-2009 was made by Councilor Abbott, seconded by Councilor Callen granting a Zone Change:

LOCAL LAW #1-2009

WHEREAS, James Best is the owner of a parcel of real property in the Town known as Tax ID#234.00-01-5.07 which is currently zoned "CT"; and

 

WHEREAS, Mr. Best has been approached by the Seventh Day Adventist Church to construct a church on said parcel; and

WHEREAS, the current CT zoning does not permit churches; and

WHEREAS, the Town Board has reviewed a Short Form EAF regarding said zone change request and finds no adverse environmental impact associated with said request to change zoning; and

WHEREAS, the Oswego County Department of Community Development, Tourism and Planning, pursuant to General Municipal Law Section 239-m has determined that no  significant County impact is involved and recommended that this should be decided as a local issue; and

WHEREAS, the Town of Granby Planning Board has recommended a negative opinion with no objection to the proposed zone change at its' April 23, 2009 meeting; and

WHEREAS the Granby Town Board has called and held a Public Hearing on May 27, 2009, on the question of the adoption of a Local Law changing the zoning designation of the above referred property and has heard all persons desiring to be heard;

NOW THEREFORE, after due deliberation the Granby Town Board does hereby:

•1.      Determine that the proposed rezoning will have no adverse environmental impact and issues a negative declaration; and

•2.      Adopt Local Law #1 of 2009 and directs that the same be filed with the Secretary of State as required by law.

A motion was made by Councilor Callen, seconded by Supervisor Williamson to authorize Highway Superintendent Moyer an expenditure of $200.00 to obtain an appraisal by Oswego County Soil & Water advising the Town Board on the value of standing timber on the property owned by the Town on Stoney Robby Rd.

Councilor Abbott asked about the Town Clerk's Office being closed on Fridays in the summer.  The Town Clerk responded that the Board voted a number of years ago to put into the Town of Granby Handbook that Town offices would be closed on Fridays June through Labor Day. 

Reports from Departments & Committees

County Legislator:  Morris Sorbello reported that negotiations have started for the development of a fourth nuclear plant in Oswego which would create many jobs. / Next Legislative Meeting is Thursday. June 11th at 7:00 p.m.  / Fulton Boiler is adding on. / Sunoco is hoping to run the Ethanol Plant.

Dog Control Officer:  43 complaints; 5 dogs picked up; 6 released; no dogs on hand.

Historian:  is doing research for a display at the Oswego County Fair.

Town Clerk/Tax Collector:  has received notice from the County Treasurer that her tax book and records have been audited and the 2009 tax levy has been fully paid and satisfied. / Seniors ages 65-69 were reminded that it is worth it to get a $50.00 lifetime sportsman license before October 1st.

Youth Director:  20 youth came for bowling and pizza at Lakeview Lanes; activities are being planned for the July 18th Family Fun Day.

Highway Superintendent:  reported on May Highway Department activities such as sweeping roads and drainage work. / The salt dome is nearly finished but 10% of the pay has been held back until the work is complete. / Two overhead doors have been replaced. / The 1976 pickup was sold through the online auction for $811. / Moyer was questioned regarding mowing the edge of the road.  He replied that the mower still needs adjustment and the operator needs experience with the new mower.

Codes Enforcement/Zoning:  issued 30 permits and made 82 inspections in May.

Supervisor:  is working on obtaining a grant from Senator Aubertine's office to help with the cost of repairing the bridges. / The check has still not come from the NYS Court System for the new addition.

Cemeteries:  are looking good.  The property just behind the Granby Center cemetery is not part of the cemetery property.

Justices:  Judge Gideon had a meeting with the Granby Codes Officers, Justice Winkworth and Court Clerk King to discuss how to handle codes court cases without having continual postponements.

Planning Board:  will hold a Public Hearing June 18, 2009.

Payment of Town Bills

A motion was made by Councilor Callen, seconded by Councilor Richardson to approve payment of Town bills as audited for abstract #11:  $9,742.73 from General Fund; $72,984.49 from Highway Fund; $2,079.00 from Water District #3.
